Terms and Conditions of Use
Welcome to SELECTEDPRESENTATIONS.COM ("Service"), an online service of Hippocampus Technology Inc. (HT) provided for the American College of Emergency Physicians (ACEP). Your use of the Service will be subject to the terms of this Terms of Service Agreement (TOS). Use of our service implies full informed consent and agreement to abide by the TOS. The TOS may change from time to time. Use of service after a change will subject you to the new terms. IF YOU DO NOT AGREE TO THESE TERMS DO NOT USE THE SERVICE AS VIOLATION OF THE TERMS CAN LEAD TO LEGAL LIABILITY.
Participation and Conduct
During the term of this Agreement, SELECTEDPRESENTATIONS.COM grants to you a terminable at will non-exclusive single person license to use and display the Service, and to download materials available through the Service, all solely for your personal, non-commercial use. You may not transfer, assign, sub-license, share, lend, or re-sell the rights granted under this license. You may not link to our site if you sell ads on your site or you charge a subscription fee to use or access your site. No deep linking directly to articles is permitted if you sell ads on your site or you charge a subscription fee to use or access your site. Any use in violation of these limits shall constitute a violation of the terms of this license. Absolutely no framing of our site is permitted.
Copyright and Trademarks
The "web service" and "web engine" is the personal property of Hippocampus Technology Inc. (HT) HT retains the right to bar any individual or entity from the Service. Accessing the service after being barred shall constitute an act of trespass. The web service and web engine is protected by copyright and is owned by HT.
The service "content" and all materials published therein, including but not limited to lectures, articles, graphical images, interactive applications, audio clips, and video clips (collectively, the "Content"), are protected by copyright and are owned by the American College of Emergency Physicians (ACEP) and/or the original source. You may not modify the Content or re-publish, re-transmit, or otherwise distribute directly or via links any Content to any third person except for your personal, non-commercial use, as permitted by the license granted above.
Permissions
All requests for licensing, reprints, linking and other usage of material on SELECTEDPRESENTATIONS.COM should be addressed to Hippocampus Technology Inc., 2658 Griffith park Blvd #502, Los Angeles, CA 90039-2520. We will review your request and forward it to ACEP for consideration, and provide you with an approval or rejection as soon as we have evaluated the request. ACEP may also be directly contacted. Exclusions of Warranty and Liability
THE SERVICE AND ANY EXECUTABLE PROGRAMS AND OTHER MATERIALS PROVIDED THROUGH THE SERVICE ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, AND ALL EXPRESS OR IMPLIED WARRANTIES ARE HEREBY EXCLUDED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. HT and ACEP DOES NOT WARRANT THAT THE SERVICE OR ANY MATERIALS OBTAINED THROUGH THE SERVICE ARE VIRUS-FREE. IF YOU DOWNLOAD EXECUTABLE PROGRAMS FROM THE SERVICE, THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF SUCH PROGRAMS IS ASSUMED BY YOU. HT AND ACEP ARE NOT RESPONSIBLE FOR THE ACCURACY OF OR ERRORS OR OMISSIONS IN ANY SUCH PROGRAMS, AND DOES NOT WARRANT THAT THE OPERATION OF ANY SUCH PROGRAMS WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DEFECTS IN ANY SUCH PROGRAMS WILL BE CORRECTED. HT AND ACEP DOES NOT WARRANT THAT THE CONTENT OF ITS LECTURES WILL BE ERROR FREE.
HT, ACEP AND SELECTEDPRESENTATIONS.COM WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM LOST PROFITS OR REVENUE; LOSS OF USE OF OR RELIANCE ON THE SERVICE, INFORMATION PROVIDED OR OF ANY EXECUTABLE PROGRAMS; LOSS OF USE OF DATA OR EQUIPMENT; MEDICAL ERRORS AND MALPRACTICE OR ANY OTHER SIMILAR DAMAGES) ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE OR ANY CONTENT OBTAINED THROUGH THE SERVICE, EVEN IF HT OR ACEP HAS BEEN ADVISED OF THE LIKELIHOOD OF SUCH DAMAGES. IN NO EVENT SHALL HT'S, ACEP AND SELECTEDPRESENTATIONS.COM TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) RELATING TO THE SERVICE EXCEED $100.
SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
The information on this site may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). All pictures are for illustration purposes. Please note that such errors, inaccuracies or omissions may relate to product description, product picture, pricing and availability. We apologize for any inconvenience this may cause you. HT and ACEP does not edit, proof or alter in any way content provided by lecturers or conferences and is thus is not responsible for any offensive, discriminatory or erroneous content nor is it responsible for any copyright infringement that may have occurred.
In the event a product is listed at an incorrect price due to an error, HT and ACEP reserve the right to refuse or cancel any order placed for products listed at the incorrect price. HT and ACEP shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, HT and ACEP shall issue a credit refund to your credit card account in the amount of the incorrect price and the product order will be cancelled.
Before any purchase, please test your computer system with the sample downloads to ensure there will be no technical difficulties. (see NEW USER tab on front page) Ensure that you have correctly selected your purchase as ALL SALES ARE FINAL AND THERE ARE NO RETURNS. HT and ACEP may use its discretion to issue store credit in lieu of any cash or credit card return.
You must keep confidential the screen name and passwords associated with your use of Selectedpresentations.com. You agree to indemnify and hold harmless HT, ACEP and SelectedPresentations.com and its vendors for losses incurred due to someone else using your account or password as a result of your failure to use reasonable care to keep your account information confidential.
You are responsible for obtaining and maintaining at your expense all equipment and services needed to access Selectedpresentations.com, including all communications costs that you will incur to access Selectedpresentations.com through the Internet. The carrier that you use to access the Internet, such as, your telephone company or wireless carrier, may charge service fees for web browsing, e-mail and messaging that require the use of online access and wireless data services. Check with your carrier to verify the fees that may apply to you.
Notices
HT and ACEP may give notice to you through general posting on the Service, through postal notification, or through E-mail notification, in its sole discretion. You may give notice to HT and ACEP via postal mail to Hippocampus Technology Inc., 2658 Griffith park Blvd #502, Los Angeles, CA 90039-2520. ACEP may also be directed contacted. Please see the ACEP website (www.acep.org) for more information.
HT and ACEP reserves the right, in its sole discretion, to restrict or block the access of any subscriber to the Service, or any section thereof.
General
Any failure by HT and ACEP to enforce any provision of this Agreement shall not be construed as a continuing waiver of any rights under such provision. In the event that any portion of this Agreement is held unenforceable, the remaining provisions of the Agreement shall remain in full force and effect.
Indemnity
In the event you breach the terms of this license, or if, any claims are made against HT and/or ACEP (its employees, officers or directors resulting from your actions) you shall be liable to HT and ACEP for all damages, costs, judgments, expenses (including reasonable attorney fees) which it incurs.
This Agreement shall be governed by and construed in accordance with the laws of the State of California, as applied to contracts entered into and performed within California. You agree to grant jurisdiction over yourself to the courts of California and designate it as the forum for resolution of all disputes arising under this Agreement.
This Agreement states the entire agreement between the parties with respect to the Service, and all prior or contemporaneous agreements are merged herein and superseded hereby.
